- PURPOSE
These Terms and Conditions of Purchase govern the acquisition of products offered through the online store of Extremadura Gourmet, SL (hereinafter, the “Website”) by purchasers, differentiating the applicable regulations according to their commercial nature.
- PRODUCTS AND PRICES
- 2.1. INDIVIDUAL CUSTOMER (Retail – B2C): Prices indicated for the general public in the online store shall be expressed in Euros and include applicable VAT.
- 2.2. WHOLESALE / PROFESSIONAL CUSTOMER (Wholesale – B2B): Prices displayed in the exclusive area for professionals or rates assigned to companies shall be expressed in Euros and shall not include VAT or other applicable taxes, which shall be duly itemized in the final summary before proceeding to payment.
- PROCEDURE AND PAYMENT METHOD
- 3.1. Within a maximum period of 24 hours after completing the purchase, Extremadura Gourmet shall send a confirmation email assigning an order reference code.
- 3.2. The Customer must make payment through the systems specifically detailed and enabled in the Store’s payment gateway. Order confirmation is valid as proof of purchase; a formal invoice must be requested separately if required.
- RIGHT OF WITHDRAWAL AND RETURNS
- 4.1. INDIVIDUAL CUSTOMER (B2C): You have a period of 14 calendar days from receipt of the Product to withdraw from the purchase. The Product must be returned in perfect condition and in its original packaging. Direct costs of return shall be borne by the User, except in cases of defect, fault, or error attributable to the company.
- 4.2. LEGAL EXCEPTION (FOOD PRODUCTS): In accordance with Article 103 of the General Law for the Defense of Consumers and Users, returns shall not be accepted (from either individuals or professionals) of Iberian products, sausages, or meat pieces that have been opened, handled, cut, started, or deprived of their original packaging or hygienic seal, for reasons of health protection, hygiene, and rapid expiration.
- 4.3. WHOLESALE CUSTOMER (B2B): Purchases made by professionals or companies in the course of their commercial activity are not subject to the right of withdrawal. Returns shall only be accepted for defects or original hygienic-sanitary faults, which must be notified in writing to info@jaranoibericos.com within a maximum period of 48 hours from receipt.
- DELIVERY SERVICE AND CLAIMS
- 5.1. FREE MAINLAND SHIPPING: For mainland Spain, Extremadura Gourmet shall bear the entire cost of product transport, with shipping costs being free for the Customer (both individual and wholesale) without requiring a minimum purchase amount. For international or non-mainland shipments, the cost shall be calculated before payment.
- 5.2. WHOLESALE GOODS INSPECTION (B2B): The professional purchaser is obligated to examine products immediately. Claims for visible damage during transport must be noted on the carrier’s delivery note. Any claims for hidden defects or internal quality defects in the professional channel must be communicated within a maximum period of 4 days from receipt.
- DATA PROTECTION
In compliance with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 (LOPDGDD), we inform you that your personal data shall be processed by Extremadura Gourmet, SL for the purpose of managing the sale, invoicing, and shipment of products. The user may exercise at any time their rights of access, rectification, deletion, limitation, and portability by sending an email to info@jaranoibericos.com.
- APPLICABLE LAW AND JURISDICTION
- 7.1. JURISDICTION FOR CONSUMERS (B2C): In the event of a dispute with individuals, the competent jurisdiction shall be that corresponding to the consumer’s domicile. In accordance with Regulation (EU) No. 524/2013, the EU online dispute resolution platform is available at: europa.eu.
- 7.2. JURISDICTION FOR PROFESSIONALS (B2B): In the event of a dispute with companies or self-employed individuals, both parties submit, with express waiver of any other jurisdiction, to the exclusive jurisdiction of the Courts and Tribunals of Palma de Mallorca.
